Most of the cookies we use are so-called "session cookies." They are automatically deleted after your visit. Other cookies remain in your device's memory until you delete them. These cookies make it possible to recognize your browser when you next visit the site.

You can configure your browser to inform you about the use of cookies so that you can decide on a case-by-case basis whether to accept or reject a cookie. Alternatively, your browser can be configured to automatically accept cookies under certain conditions or to always reject them, or to automatically delete cookies when closing your browser. Disabling cookies may limit the functionality of this website.

Cookies which are necessary to allow electronic communications or to provide certain functions you wish to use (such as the shopping cart) are stored pursuant to Art. 6 paragraph 1, letter f of DSGVO. The website operator has a legitimate interest in the storage of cookies to ensure an optimized service provided free of technical errors. If other cookies (such as those used to analyze your surfing behavior) are also stored, they will be treated separately in this privacy policy.

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Host name of the accessing computer
  • Time of the server request
  • IP address

These data will not be combined with data from other sources.

The basis for data processing is Art. 6 (1) (b) DSGVO, which allows the processing of data to fulfill a contract or for measures preliminary to a contract.

Contact form

Should you send us questions via the contact form, we will collect the data entered on the form, including the contact details you provide, to answer your question and any follow-up questions. We do not share this information without your permission.

We will, therefore, process any data you enter onto the contact form only with your consent per Art. 6 (1)(a) DSGVO. You may revoke your consent at any time. An informal email making this request is sufficient. The data processed before we receive your request may still be legally processed.

We will retain the data you provide on the contact form until you request its deletion, revoke your consent for its storage, or the purpose for its storage no longer pertains (e.g. after fulfilling your request). Any mandatory statutory provisions, especially those regarding mandatory data retention periods, remain unaffected by this provision.

Registration on this website

You can register on our website in order to access additional functions offered here. The input data will only be used for the purpose of using the respective site or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise, we will reject your registration.

To inform you about important changes such as those within the scope of our site or technical changes, we will use the email address specified during registration.

We will process the data provided during registration only based on your consent per Art. 6 (1)(a) DSGVO. You may revoke your consent at any time with future effect. We will continue to store the data collected during registration for as long as you remain registered on our website. Statutory retention periods remain unaffected.

Processing of data (member, customer and contract data)

We collect, process, and use personal data only insofar as it is necessary to establish, or modify legal relationships with us (master data). This is done based on Art. 6 (1) (b) DSGVO, which allows the processing of data to fulfill a contract or for measures preliminary to a contract. We collect, process and use your personal data when accessing our website (usage data) only to the extent required to enable you to access our service or to bill you for the same.

Collected customer data shall be deleted after completion of the order, termination of the membership or termination of the business relationship. Legal retention periods remain unaffected.

4. Spam Protection Tool

hCaptcha by Intuition Machines Inc.

We use the "hCaptcha"-tool on our website. This service is provided by Intuition Machines, Inc. 1065 SW 8th St #704, Miami FL 33130, USA.

In order to protect the privacy of our customers and the availability of our website from automated and abusive access attempts even more reliably, we use the hCaptcha technology.

The service uses bot detection and risk assessments trained through machine learning to determine whether visitors to our website are humans. If required, an interactive task for validation is displayed when using the website. If you registered for the barrier-free service from this company, the system reads the relevant cookie with the duration of one month instead of providing a validation task.

The legal basis for the use of the technology is Art. 25 (2) (2) of the TTDSG in conjunction with Art. 6 (1) (f) GDPR. The legitimate interest is to protect the data of the data subjects and the infrastructure from automated and abusive access attempts.

For more information about hCaptcha by Intuition Machines Inc., please visit the following links: https://www.hcaptcha.com/privacy and https://www.hcaptcha.com/terms.

5. Newsletter

Newsletter data

If you would like to receive our newsletter, we require a valid email address as well as information that allows us to verify that you are the owner of the specified email address and that you agree to receive this newsletter. No additional data is collected or is only collected on a voluntary basis. We only use this data to send the requested information and do not pass it on to third parties.

We will, therefore, process any data you enter onto the contact form only with your consent per Art. 6 (1) (a) DSGVO. You can revoke consent to the storage of your data and email address as well as their use for sending the newsletter at any time, e.g. through the "unsubscribe" link in the newsletter or by notification to our contact address. The data processed before we receive your request may still be legally processed.

The data provided when registering for the newsletter will be used to distribute the newsletter until you cancel your subscription when said data will be deleted. Data we have stored for other purposes (e.g. email addresses for the members area, contract data, data related to certification processes, data related to participation in training or events) remain unaffected.

6. Classified data

You can publish free-of-cost classifieds on the website by entering the data in an online form. Since the purpose of the classified ad is to be contacted by interested parties it is intended to enter a specified set of mandatory contact data. We may use these contact details to contact you to verify the authenticity of the classified ad. Each classified ad is manually controlled and will only be published if it complies with the netiquette and does not violate any law or association's rules. ERCA cannot be held liable for the content of third party advertisements.
After 180 days, the classified ad will automatically unpublished and removed. 7 days before the expiry date of the classified ad you will receive an automatic e-mail reminder. You can then decide if the classified ad expiry date should be extended again.
You can amend, limit or revoke your consent by notice to the above mentioned contact address at any time and with future effect. The data processed before we receive your request may still be legally processed.

7. Privacy Policy for the Certification System

Our separate privacy policy for the ERCA Training and Inspection Certification System can be found on the following separate website, which is used for managing the certification system: Privacy Policy for the ERCA Intranet.

8. Plugins and tools

DW-Formmailer

Some online forms are provided by our service provider 'DW Formmailer'. For the purpose of data transmission, those forms are either embedded on our website or you will being redirected to the 'DW-Formmailer website'. For website visitors, it is not obvious at first glance whether the form is an embedded one (from our service provider DW-Formmailer) or an erca.cc-hosted one. The embedding of forms runs in the background and website visitors are not informed about technical embedding of a form. The operator of the DW-Formmailer service is Wolfgang Dürr (Einzelunternehmen), In den Kehlen 4, 97342 Marktsteft, Germany. We have concluded an agreement for data processing between us and the service provider.

For more information on how to handle user data, please refer to the DW-Formailler Privacy Policy at: https://www.dw-formmailer.de/index.php?action=datenschutz

Google Maps

This site uses the Google Maps map service via an API. It is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

To use Google Maps, it is necessary to save your IP address. This information is generally transmitted to a Google server in the USA and stored there. The provider of this site has no influence on this data transfer.

The use of Google Maps is in the interest of making our website appealing and to facilitate the location of places specified by us on the website. This constitutes a justified interest pursuant to Art. 6 (1) (f) DSGVO.

Further information about handling user data, can be found in the data protection declaration of Google at https://www.google.de/intl/en/policies/privacy/.

9. Our social media appearances

Data processing through social networks

We maintain publicly available profiles in social networks. The individual social networks we use can be found below.

Social networks such as Facebook, Google+ etc. can generally analyse your user behaviour comprehensively if you visit their website or a website with integrated social media content (e.g. like buttons or banner ads). When you visit our social media pages, numerous data protection-relevant processing operations are triggered. In detail:

If you are logged in to your social media account and visit our social media page, the operator of the social media portal can assign this visit to your user account. Under certain circumstances, your personal data may also be recorded if you are not logged in or do not have an account with the respective social media portal. In this case, this data is collected, for example, via cookies stored on your device or by recording your IP address.

Using the data collected in this way, the operators of the social media portals can create user profiles in which their preferences and interests are stored. This way you can see interest-based advertising inside and outside of your social media presence. If you have an account with the social network, interest-based advertising can be displayed on any device you are logged in to or have logged in to.

Please also note that we cannot retrace all processing operations on the social media portals. Depending on the provider, additional processing operations may therefore be carried out by the operators of the social media portals. Details can be found in the terms of use and privacy policy of the respective social media portals.

Legal basis

Our social media appearances should ensure the widest possible presence on the Internet. This is a legitimate interest within the meaning of Art. 6 (1) lit. f GDPR. The analysis processes initiated by the social networks may be based on divergent legal bases to be specified by the operators of the social networks (e.g. consent within the meaning of Art. 6 (1) (a) GDPR).

Responsibility and assertion of rights

If you visit one of our social media sites (e.g., Facebook), we, together with the operator of the social media platform, are responsible for the data processing operations triggered during this visit. You can in principle protect your rights (information, correction, deletion, limitation of processing, data portability and complaint) vis-à-vis us as well as vis-à-vis the operator of the respective social media portal (e.g. Facebook).

Please note that despite the shared responsibility with the social media portal operators, we do not have full influence on the data processing operations of the social media portals. Our options are determined by the company policy of the respective provider.

Storage time

The data collected directly from us via the social media presence will be deleted from our systems as soon as the purpose for their storage lapses, you ask us to delete it, you revoke your consent to the storage or the purpose for the data storage lapses. Stored cookies remain on your device until you delete them. Mandatory statutory provisions - in particular, retention periods - remain unaffected.

We have no control over the storage duration of your data that are stored by the social network operators for their own purposes. For details, please contact the social network operators directly (e.g. in their privacy policy, see below).

Individual social networks
